When do exclusions apply

Compensable pharmaceutical injuries and policy exclusions are defined in more detail in the terms and conditions governing pharmaceutical injuries insurance.

The following is a brief list of the most common reasons why a claim may not be accepted under pharmaceutical injuries insurance:

  • Injury has occurred before policy inception
  • Notice of injury is filed too late
  • Injury is not likely to result from use of pharmaceutical
  • Injury results from necessary risk taking during treatment of severe disease
  • Injury is reasonably tolerable in view of the disease that is being treated
  • Injury is insignificantInjury results from failure of pharmaceutical to have the intended effect
  • Injury results from improper medication (patient injury)
  • Injury results from misuse of pharmaceutical
